Seventh District Enforces Arbitration Clause in Oil and Gas Leases

Buckingham’s oil and gas team was victorious in two appeals recently decided by the Seventh District Court of Appeals concerning the enforceability of arbitration clauses in oil and gas leases. The Court of Appeals held that arbitration clauses in oil and gas leases are enforceable and are not subject to R.C. § 2711.01(B), which excludes certain types of real estate disputes from being referred to arbitration. This holding establishes a favorable legal precedent in Ohio. The Court of Appeals further held, among other things, that the specific arbitration clause at issue requiring all disputes to be submitted to binding arbitration in accordance with the AAA rules was not unconscionable.
