Client Alert – Cybersecurity “Safe Harbor” in Ohio for Data Breach Lawsuits

Ohio’s new Data Protection Act will help safeguard businesses from legal action if they meet industry-recognized standards in precautions against cyber threats. The regulations are designed to encourage businesses to take measures and setup programs to help minimize data breaches. Given the substantial legal and reputational risks involved, Ohio businesses should understand the increased level of cybersecurity that will entitle businesses to be a “legal safe harbor.”

The law is intended to be flexible based on the size and type of business rather than a “one-size-fits-all” program. Business owners should note that the law does not provide blanket immunity; however, it does create defense against lawsuits, such as negligence and invasion of privacy.
