The Sixth Circuit Court of Appeals, which sits in Cincinnati, Ohio, won the legal lottery yesterday. The challenges to OSHA’s Vaccination and Testing ETS will be consolidated and transferred to the Sixth Circuit where the case will be heard by a three-judge panel. The Sixth Circuit will also have the opportunity to lift, modify or extend the stay that was put into place by the Fifth Circuit Court of Appeals on November 12, 2021.
