Option A :  No, cities and states have inherent police powers that permit them to regulate activities that affect the public health, safety, morals, or general welfare.  See Village of Euclid, 272 U.S. 365 (1926).  Courts have construed these provisions broadly and have permitted state actions that only tenuously relate to a public interest.  Imposing the condition provides the public with greater access to the beach.  This reason would almost certainly hold up to scrutiny.  Try again.
